Minister in the Prime Minister’s Department Datuk Seri Nazri Abdul Aziz said the persons directly involved in the case will not participate in the decision-making process.
He said there are two aspects to the A-G, namely the A-G as an individual, and the A-G as an institution which comprises other officials such as the deputy A-G or the solicitor-general.
"The decision whether to prosecute or not will not be decided by the A-G as an individual but will be made by the A-G as an institution. And, because of conflict of interests, surely he (A-G) will not take part.
"So in this case, although conflict of interests may exist, it could still be implemented as there are other officials who can take part in the decision-making process," he said in reply to a supplementary question from Mohd Yusmadi Mohd Yusoff (PKR-Balik Pulau) today.
Referring to the police report lodged against the two by PKR adviser Datuk Seri Anwar Ibrahim, Mohd Yusmadi had asked how investigations could be carried out with integrity as the ACA does not have prosecution power and the A-G will have to decide on prosecution.
Nazri added that in order to preserve integrity, the government is open to proposals, including that of having a special prosecutor for the case.
"Justice must be seen to be done. I think the government is always open. Once we reach that stage, we will decide what to do," he added.
